In May 2019, BBB met with representatives of Blue World Pools after a routine review of complaints filed against the company indicating consumers may not have a clear understanding of Blue World Pool's contract. BBB requested the company's voluntary cooperation in providing a copy of Blue World Pool's current contract.

Blue World Pools informed BBB it has created a dedicated email address their customers should use to voice concerns prior to filing a complaint with BBB. BBB strongly encourages consumers to email Blue World Pools at BBB@BlueWorldPools.com, and allow them 72 hours (excluding weekends and holidays) to resolve the matter prior to filing a complaint with BBB.

  • Buyer's Remorse: When the FTC's Cooling-Off Rule May Help
  • The FTC's Cooling-Off Rule gives you a 3-day right to cancel a sale made at your home, workplace or dormitory, or at a seller's temporary location, like a hotel or motel room, convention center, fairground or restaurant.
  • It also applies when you invite a salesperson to make a presentation in your home. But not all sales are covered.

At the Time of Sale:

By law, the seller must tell you about your right to cancel at the time of sale. The seller also must give you two copies of a cancellation form (one to keep and one to send if you decide to cancel your purchase) and a copy of your contract or receipt.

The contract or receipt should be dated, show the name and address of the seller, and explain your right to cancel. The contract or receipt must be in the same language that is used in the sales presentation. Your right to cancel for a full refund extends until midnight of the third business day after the sale.

Exceptions to the Rule:

Certain types of sales can't be canceled, even if they take place in places normally covered by the Rule.

The Cooling-Off Rule does not cover sales that are:

  • under $25 for sales made at your home;
  • under $130 for sales made at temporary locations;
  • for goods or services not primarily intended for personal, family or household purposes. (The Rule applies to courses of instruction or training.);
  • made entirely online, or by mail or telephone;
  • the result of prior negotiations at the seller's permanent place of business where the goods are sold regularly;
  • needed to meet an emergency;
  • made as part of your request for the seller to do repairs or maintenance on your personal property (purchases made beyond the maintenance or repair request are covered).
  • Also exempt from the Cooling-Off Rule are sales that involve:
  • real estate, insurance, or securities;
  • automobiles, vans, trucks, or other motor vehicles sold at temporary locations if the seller has at least one permanent place of business;
  • arts or crafts sold at fairs or places like shopping malls, civic centers, and schools.

How to Cancel:

You don't have to give a reason for canceling your purchase. You have the right to change your mind.

To cancel a sale, sign and date one copy of the cancellation form.

Mail it to the address given for cancellations, making sure the envelope is post-marked before midnight of the third business day after the contract date. Saturday is considered a business day; Sundays and federal holidays are not.

Because proof of the mailing date and receipt are important, consider sending the cancellation form by certified mail so you can get a return receipt. Keep the other copy of the cancellation form for your records.

If the seller didn't give you cancellation forms, you can write a cancellation letter. It must be post-marked within three business days of the sale.

If You Cancel:

If you cancel your purchase, the seller has 10 days to:

  • cancel and return any check you signed;
  • refund all your money and tell you whether any product you still have will be picked up; and
  • return any trade-in.

Within 20 days, the seller must either pick up the items left with you, or reimburse you for mailing expenses, if you agree to send back the items.

If you received any goods from the seller, you must make them available to the seller in as good condition as when you got them. If you don't make the items available to the seller -- or if you agree to return the items but don't -- you remain obligated under the contract.

If You Have Problems:

If you think a seller has violated the FTC's Cooling-Off Rule, file a complaint with us.

You also may wish to contact your state Attorney General or Better Business Bureau.

Some state laws give you more rights than the FTC's Cooling-Off Rule, and some local consumer offices can help you resolve your complaint.

If you paid for your purchase with a credit card and a billing dispute arises about the purchase --for example, if the merchandise shipped was not what you ordered -- you can notify your credit card company that you want to dispute the purchase.

By law, the credit card company must acknowledge your dispute in writing and conduct a reasonable investigation of your problem. You may withhold payment of the amount in dispute, but only until the dispute is resolved. You are still required to pay any part of your bill that is not in dispute.

To protect your rights, you must send a written notice about the problem to the credit card company at the address for billing disputes listed on your billing statement within 60 days after the first bill containing the disputed amount is mailed to you.

They do not give fax numbers, I did not receive any cancellation forms. I read the contract it advises to send a telegram to Reno,NV. I sent my own cancellation letters to the Atlanta Georgia office and RENO, NV. The sales personnel are not helpful. I would not reccomend this company at all. They wanted my mortgage info and my loan number. I can't believe they are still in operation. Read from all the people that are being scammed, it's unreal.

Pay the safest way

Credit cards are the safest way to pay for online purchases because you can dispute the charges if you never get the goods or services or if the offer was misrepresented. Federal law limits your liability to $50 if someone makes unauthorized charges to your account, and most credit card issuers will remove them completely if you report the problem promptly.

Guard your personal information

In any transaction you conduct, make sure to check with your state or local consumer protection agency and the Better Business Bureau (BBB) to see if the seller, charity, company, or organization is credible. Be especially wary if the entity is unfamiliar to you. Always call the number found on a website’s contact information to make sure the number legitimately belongs to the entity you are dealing with.

Be careful of the information you share

Never give out your codes, passwords or personal information, unless you are sure of who you're dealing with

Know who you’re dealing with

Crooks pretending to be from companies you do business with may call or send an email, claiming they need to verify your personal information. Don’t provide your credit card or bank account number unless you are actually paying for something and know who you are sending payment to. Your social security number should not be necessary unless you are applying for credit. Be especially suspicious if someone claiming to be from a company with whom you have an account asks for information that the business already has.

Check your accounts

Regularly check your account transactions and report any suspicious or unauthorised transactions.

Don’t believe promises of easy money

If someone claims that you can earn money with little or no work, get a loan or credit card even if you have bad credit, or make money on an investment with little or no risk, it’s probably a scam. Oftentimes, offers that seem too good to be true, actually are too good to be true.

Do not open email from people you don’t know

If you are unsure whether an email you received is legitimate, try contacting the sender directly via other means. Do not click on any links in an email unless you are sure it is safe.

Think before you click

If an email or text message looks suspicious, don’t open any attachments or click on the links.

Verify urgent requests or unsolicited emails, messages or phone calls before you respond

If you receive a message or a phone call asking for immediate action and don't know the sender, it could be a phishing message.

Be careful with links and new website addresses

Malicious website addresses may appear almost identical to legitimate sites. Scammers often use a slight variation in spelling or logo to lure you. Malicious links can also come from friends whose email has unknowingly been compromised, so be careful.

Secure your personal information

Before providing any personal information, such as your date of birth, Social Security number, account numbers, and passwords, be sure the website is secure.

Use Strong Passwords

Strong passwords are critical to online security.

Keep your software up to date and maintain preventative software programs

Keep all of your software applications up to date on your computers and mobile devices. Install software that provides antivirus, firewall, and email filter services.

Update the operating systems on your electronic devices

What if You Got Scammed?

Stop Contact With The Scammer

Hang up the phone. Do not reply to emails, messages, or letters that the scammer sends. Do not make any more payments to the scammer. Beware of additional scammers who may contact you claiming they can help you get your lost money back.

Secure Your Finances

  • Report potentially compromised bank account, credit or debit card information to your financial institution(s) immediately. They may be able to cancel or reverse fraudulent transactions.
  • Notify the three major credit bureaus. They can add a fraud alert to warn potential credit grantors that you may be a victim of identity theft. You may also want to consider placing a free security freeze on your credit report. Doing so prevents lenders and others from accessing your credit report entirely, which will prevent them from extending credit:

Check Your Computer

If your computer was accessed or otherwise affected by a scam, check to make sure that your anti-virus is up-to-date and running and that your system is free of malware and keylogging software. You may also need to seek the help of a computer repair company. Consider utilizing the Better Business Bureau’s website to find a reputable company.

Change Your Account Passwords

Update your bank, credit card, social media, and email account passwords to try to limit further unauthorized access. Make sure to choose strong passwords when changing account passwords.

Report The Scam

Reporting helps protect others. While agencies can’t always track down perpetrators of crimes against scammers, they can utilize the information gathered to record patterns of abuse which may lead to action being taken against a company or industry.

Report your issue to the following agencies based on the nature of the scam:

  • Local Law Enforcement: Consumers are encouraged to report scams to their local police department or sheriff’s office, especially if you lost money or property or had your identity compromised.
  • Federal Trade Commission: Contact the Federal Trade Commission (FTC) at 1-877-FTC-HELP (1-877-382-4357) or use the Online Complaint Assistant to report various types of fraud, including counterfeit checks, lottery or sweepstakes scams, and more.
  • Identitytheft.gov: If someone is using your personal information, like your Social Security, credit card, or bank account number, to open new accounts, make purchases, or get a tax refund, report it at www.identitytheft.gov. This federal government site will also help you create your Identity Theft Report and a personal recovery plan based on your situation. Questions can be directed to 877-ID THEFT.
