I got this email even though I didn't have a Diablo III account. When I received it the first time, I just kicked it to the spam folder. But it didn't stop there, the sender kept sending a variation of the same email, sometimes with Diablo fanart from deviantart (in case they thought it wasn't convincing enough).Told em to p**s off and blocked the sender.
